Acceptance of these Terms

By accessing or using our website, creating an account, booking services, or submitting a job application, you agree to be bound by these Terms of Use (“Terms”). If you do not agree, do not use the site. Where you use electronic forms, signatures, or acceptances on the site, such actions may constitute legally valid consent and agreement in Ghana under the Electronic Transactions Act, 2008 (Act 772).

 

Who may use the site

You must be 18 years or older (or have verifiable parental/guardian consent) to create an account, make a booking, or submit a job application. You represent that the information you provide is accurate and complete, and that you have authority to act (e.g., for a patient family member or employer).

 

Our services

ONOT provides healthcare coordination, concierge, medical travel/repatriation support, homecare coordination, and related logistics – not direct emergency medical services. Clinical services may be delivered by third‑party licensed providers or contractors under separate arrangements; ONOT coordinates and manages logistics and care flow. Service availability can vary by location, partner capacity, and regulatory requirements.

 

Accounts, verification and security

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. We may enable multi‑factor authentication and one‑time passcodes (OTP) where applicable. Notify us immediately of any unauthorized use or security breach. We may suspend or terminate accounts to protect users or comply with law.

 

Bookings, quotes, deposits and payments

·       Booking and intake: When you request a service, you will be required to complete all informational requirements and may upload documents (e.g., identification, medical summaries). We may issue a quote or request additional information before confirming.

·       Payments and mobile money: We may collect deposits, prepayments, or fees through cards and mobile money systems operated by licensed payment service providers/e‑money issuers regulated under Ghana’s Payment Systems and Services Act, 2019 (Act 987) and supervised by the Bank of Ghana. ONOT itself is not a payment service provider; we use authorized processors to complete transactions. Fees, foreign exchange, and mobile network charges may apply.

·       Cancellations and refunds: Cancellations, refund eligibility, and non‑refundable components (e.g., third‑party reservations, visas, air ambulances) will be disclosed case‑by‑case at booking or in your service confirmation.

·       Invoices and taxes: Invoices will reflect service descriptions, applicable taxes, and any pass‑through costs. You are responsible for providing accurate details for billing and timely payments.

 

Careers and job applications

If you apply for a role, you consent to our processing of your application data (e.g., CV, licenses, references), background verification where lawful, and necessary communications about your candidacy. Submitting an application does not create an employment contract or guarantee selection.

 

Privacy, health information and data protection

Your privacy matters to us. Our Privacy Policy explains what we collect, why, and how we use and safeguard it, including cookies/analytics and your rights. Health‑related information is special personal data under Ghana law and receives enhanced protections. We handle personal data in line with the Data Protection Act, 2012 (Act 843) and guidance from the Data Protection Commission (Ghana), including registration (where applicable), purpose limitation, security safeguards, breach notification, and data‑subject rights. Cross‑border processing may occur where you or partners are outside Ghana. We will apply appropriate safeguards in accordance with Act 843 and relevant guidance.

 

Electronic communications and signatures

By using the site, you agree we may communicate with you electronically (email, SMS, WhatsApp, in‑portal messages). Where applicable, you consent to use of electronic signatures, which are recognized under the Electronic Transactions Act, 2008 (Act 772). Certain document types may still require wet ink formalities under Ghanaian law; where this applies, we will inform you.

 

Acceptable use

You agree not to:

·       Violate any applicable law or third‑party rights

·       Upload content that is unlawful, deceptive, defamatory, or invasive of privacy

·       Interfere with the site’s operation, security, or networks

·       Attempt to access another user’s account or data without authorization

·       Send spam or automated messages

We may suspend or restrict access for suspected violations.

 

Third‑party providers and links

Our site may reference or integrate third‑party services (e.g., hospitals, transport, labs, payment processors). Those providers operate under their own terms and policies. ONOT is not responsible for third‑party content, actions, or omissions. Where required, we will disclose third‑party terms at point of use.

 

Intellectual property

All site content, trademarks, logos, text, graphics, software and other materials are owned by ONOT or licensed to ONOT and are protected by applicable Intellectual Property (IP) laws. You may use the site for personal, non‑commercial purposes. Copying, modifying, distributing, or reverse engineering is prohibited unless legally permitted or expressly authorized by ONOT.

·       No medical advice: Content on the site is for coordination and service logistics; it is not medical advice, diagnosis, or treatment. Always seek the advice of a qualified clinician.

·       Site availability: We provide this site “as is” and “as available.” We do not guarantee uninterrupted or error-free operation, nor the accuracy or completeness of content, to the maximum extent permitted by law.

 

Limitation of liability

To the fullest extent permitted by law, ONOT and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or reputational harm, arising out of or related to your use of the site or services. We do not limit liability where such limitation is prohibited by law.

 

Indemnity

You agree to indemnify and hold harmless ONOT, its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way related to your misuse of the site, violation of these Terms, or infringement of third-party rights.

 

Suspension and termination

We may suspend, restrict, or terminate your access at any time (with notice where feasible) if we reasonably believe you have violated these Terms, posed a security risk, or where required by law or a competent authority. Upon termination, other clauses (e.g., IP, disclaimers, limitations, indemnity, governing law) will continue to apply.

 

Governing law and dispute resolution

These Terms are governed by the laws of the Republic of Ghana. Before litigation, the parties will seek to resolve disputes amicably and may submit to mediation or arbitration consistent with Ghana’s Alternative Dispute Resolution Act, 2010 (Act 798). Nothing prevents a party from seeking injunctive or equitable relief in the competent courts in Ghana. Venue for court proceedings will be the courts of competent jurisdiction in Accra, Ghana.

 

Changes to the site and Terms

We may modify the site and these Terms at any time. Where changes are material, we will post an updated version with a new effective date and, where appropriate, provide additional notice. Your continued use after changes become effective constitutes acceptance of the updated Terms.

 

Miscellaneous

·       Entire agreement: These Terms, together with the Privacy Policy and any service-specific terms or confirmations, are the entire agreement between you and ONOT regarding the site.

·       Severability: If any provision is invalid or unenforceable, the remaining provisions will continue in full force.

·       No waiver: A failure to enforce a provision is not a waiver.

·       Assignment: You may not assign these Terms without our prior written consent; we may assign in connection with a merger, acquisition, or asset transfer.

·       Force majeure: We are not liable for delays or failures due to events beyond our reasonable control.
